ARTICLE 1 - PARTICIPATION CONDITIONS FOR CREATOR CAMPAIGNS
Skeepers organizes Campaigns (calls for contributions organized by Skeepers at the request of its client concerning one or more products or services determined by the client and aimed at creating and disseminating Videos on any type of medium) inviting Creators (users who have participated in a Campaign and uploaded a Video on the Skeepers platform as part of that Campaign) to evaluate the products of Skeepers' clients and share their experience through a Video (any audiovisual recording composed of images and sounds, uploaded on the platform by a Creator as part of the Campaigns and broadcasted by the Client).
The Creator is not paid for producing the Video; however, they may potentially be rewarded. If so, the reward may take the form of product giveaways, vouchers, promo codes, free stays... The reward is never dependent on the positive or negative nature of the video, but only on its relevance.
In some cases, the Creator may be a collaborator of Skeepers' client. If so, it is specified in the video brief to present themselves as such.
When Creators receive Products directly for testing (product giveaway), in accordance with current regulations, Creators must include within each Video and associated content, a clear and unambiguous disclaimer stating that they received the Products for free, including at the beginning of the Video an oral statement easily audible and understandable to the public. For example: "I just received this product from the site example.com," or "I was not paid to give my opinion, this review is solely my own."
ARTICLE 2 - VIDEO CONTENT AND MODERATION
Creators have guaranteed to Skeepers in a rights transfer agreement for each Video and image rights transfer that their Videos and associated content are original and personal creations.
All Videos have undergone a Moderation Check (filtering, analysis, or process conducted either automatically or by human means to accept or reject an application and/or a Video) by Skeepers and/or the Client before being published on the site. Under no circumstances has the selection been random.
The videos will be subject to moderation in the following cases:
- Non-compliance with the initial brief (type of video, brand image,...)
- Non-compliance with the deadlines mentioned in the briefs, if applicable
- Presence of personal data
- Presence of inappropriate content:
- Inciting hatred, violence, or discrimination based on people's origin, race, religion, gender, sexual orientation;
- Constituting sexual harassment;
- Violating human dignity (such as human trafficking or pimping);
- Glorifying or denying the existence of crimes against humanity;
- Promoting terrorism;
- Glorifying very serious crimes against individuals (e.g., murder and sexual assault);
- Glorifying theft, extortion, and property damage, dangerous to individuals;
- Constituting child pornography.
If the video contains any of the elements mentioned above, Skeepers commits to contacting the Creator and requesting additional footage/videos so that their video review can be validated in accordance with the above criteria.
In the case of a product giveaway, the Creator commits to sending videos that comply with the previous criteria, under penalty of receiving reminder and formal notice letters if necessary.
ARTICLE 3 - VIDEO CREATION PROCESS
In accordance with current regulations and its own requirements, Skeepers ensures that each published Video represents an authentic user review and provides the test dates and the review publication date.
Videos are related to a consumption experience and sent by a clearly identified Creator. It is noted that Skeepers acts as a trusted third party. Each Video must necessarily relate to a consumption experience experienced by the Creator of that Video. Also, Video Creators must strictly adhere to the following conditions:
- Be a natural person;
- Have personally experienced the consumption of the product or service that their Video is about;
- Be at least 18 years old or have parental consent.
The Creator guarantees the sincerity and authenticity of their Video. They must refrain from making inappropriate statements or those contrary to the law and public morals.
Skeepers commits to indicating on each video broadcast via its PLAYER the following information:
- The test date, which corresponds to the date of uploading the latest video (the most recent) by the Creator on the Skeepers Platform;
- The review publication date corresponds to the most recent publication date (Status "Published" on the Skeepers Platform) of the Video by Skeepers.
Skeepers commits to retaining and broadcasting video reviews via its player for a maximum period of 20 years.
